Please take a moment to read the following before booking a portrait. These terms are here to make sure everything is clear and straightforward for both of us, from choosing your photographs to receiving your finished artwork

TERMS AND CONDITIONS

These Terms & Conditions apply to all pet portrait commissions booked with Naiara Climent. By booking a commission and making the initial deposit payment, you agree to these Terms & Conditions.

Please read them carefully before confirming your commission. A copy of the Terms & Conditions that applies to your commission will be available for you to download along with your confirmation email.

  1. General information

Naiara Climent is an independent illustrator specialising in traditional coloured pencil pet portraits.

Each portrait is individually drawn by hand from photographs supplied by the client. Every finished artwork is an original piece and may contain small variations as a result of the handmade nature of the work.

Before a commission is confirmed, the client will be provided with an email confirming the agreed portrait size, number of subjects, price, any applicable delivery costs and any other terms discussed and agreed upon during previous communication, along with an attached copy of this document.

These Terms & Conditions apply to the commission as agreed at the time of booking.

  1. The portrait

All portraits are drawn by hand using traditional coloured pencil techniques on paper.

While I aim to create a highly accurate and lifelike representation of your pet, the finished artwork is a handmade interpretation of the reference photographs and will not be an exact reproduction of them.

Small differences in colour, texture, proportions or other details may occur as part of the artistic process.

The appearance of colours may also vary slightly between the original artwork, photographs of the artwork and different screens or devices.

The portrait size and number of subjects included will be those agreed at the time of booking. Any additional subjects or significant changes requested after the commission has been confirmed may require an additional charge or be disregarded.

Frames and mounts are not included unless specifically agreed in writing.

  1. Reference photographs

The quality of the reference photographs has a significant impact on the finished portrait.

Clients are responsible for providing photographs that they have the right to use as references. If a photograph was taken by a professional photographer or belongs to another person, the client is responsible for obtaining any necessary permission before providing it to me.

I may ask for additional photographs or information if I believe this will help me create the best possible portrait.

If the photographs provided are not suitable for the requested portrait, I will discuss this with the client before the commission begins. If we are unable to find suitable reference material, I may decline the commission.

If you are commissioning a portrait of a pet who has passed away, I am very happy to work from older photographs and will do my best to advise you on which images are likely to produce the strongest result.

Clients are welcome to contact me before booking if they are unsure which photographs to use.

4. Enquiries & Booking

All commissions begin with an enquiry.

Submitting an enquiry does not itself constitute a confirmed booking. I will review the requested commission and confirm availability, the agreed portrait details, pricing and any other relevant information before the booking is confirmed.

A commission is only considered confirmed once the client has accepted the agreed details and made the initial deposit payment required to secure the booking.

The commission will not begin until I have received the information and photographs required to proceed.

If a client takes a significant amount of time to provide the necessary photographs or information, the estimated completion date may need to be adjusted.

  1. Payment

The total price of the commission will be confirmed before the booking is made.

Payment must be made using one of the payment methods provided, which includes bank transfer or Online payment through a Revolut Business link. Bank details or link will be provided upon confirmation of the booking.

A 50% deposit is required to confirm the booking for your commission and secure the provided timeline. The remaining balance must be paid before the original artwork is dispatched.

I will never ask a client to pay additional charges that were not previously agreed, except where the client requests additional work, changes to the agreed commission or additional delivery services.

  1. Cancellations

Because pet portraits are individually created and personalised for each client, cancellation rights may differ from those that apply to standard, non-personalised products.

If you wish to cancel your commission, please contact me as soon as possible by email.

If a commission is cancelled before I have started work, I will confirm what amount, if any, is refundable based on the circumstances of the cancellation and any costs already reasonably incurred.

If work has already started, any amount retained will be limited to amounts reasonably reflecting work already carried out, costs already incurred or other direct losses arising from the cancellation.

I will always take reasonable steps to minimise any loss resulting from a cancellation.

Nothing in these Terms & Conditions affects any statutory rights you may have under UK consumer law.

  1. Changes to a Commission

Once a commission has been confirmed, I will work from the agreed photographs, composition, size and number of subjects.

If you request changes after the commission has been confirmed, I will do my best to accommodate them where reasonably practicable.

Minor adjustments may be possible during the drawing process. Requests that require substantial changes to completed artwork, a new composition, additional subjects or significantly different reference photographs may incur an additional charge.

I will discuss any additional cost with you and obtain your agreement before carrying out substantial additional work.

  1. Turnaround Times

I will provide an estimated timeline and a completion date when your commission is confirmed.

The estimated timeframe begins once I have received the information, photographs and payment required to begin the commission.

I will always do my best to complete your portrait within the agreed timeframe. However, estimated dates may change due to circumstances outside my reasonable control, including delays in receiving information from the client, illness, unexpected technical or supply issues, or significant disruption to postal or delivery services.

If I become aware of a significant delay, I will contact you as soon as possible and actively try to minimise the final impact to the total timeline.

If you require a portrait for a particular date, please mention this when making your enquiry. I will let you know whether I can accommodate the requested date before the commission is confirmed.

9. Progress Updates & Final Preview

Depending on the agreed process option of each particular commission, I may provide progress images or a preview during the drawing process.

You may choose between the following process options at the time of booking:

Option 1 — Live the Process
With this option, you will receive selected photos and/or videos of the artwork during the drawing process, allowing you to follow its development. These updates are intended to provide an overview of the progress and overall direction of the artwork rather than to constitute a series of formal revision stages. Images and videos provided belong to the artist and are not to be shared without prior permission and consent.

Option 2 — Keep the Surprise
If you choose this option, you will not receive any progress photos or videos while the artwork is being created. Under this option, you may choose between:

  • Final Preview: you will receive a photo of the completed artwork before it is packaged and dispatched.

  • Full Surprise: the Client will not receive any images of the artwork before delivery and will see the completed artwork for the first time in person. By choosing this option, allow full creative freedom and agree to trust the Artist to complete the artwork without progress updates or pre-delivery approval.

Where progress images or a final preview are provided, they might but not necessarily are intended for approvals. While work updates allow the Artist and Client to confirm that the overall direction and result are aligned before the artwork is packaged and dispatched, a preview does not constitute an unlimited revision stage or a guarantee that all requested changes can be accommodated.

As the artwork is individually hand-drawn, changes may become difficult or impossible once certain areas have been completed. I will always aim to work collaboratively, but requests for substantial alterations to completed artwork may incur an additional charge where they require significant additional work, as outlined in Section 7.

  1. Delivery & Shipping

The original artwork will only be dispatched once any outstanding balance has been paid.

Portraits will be packaged carefully and appropriately for their journey.

Delivery charges and the available delivery method will be confirmed before the commission is booked.

Estimated delivery times are provided by the relevant postal or courier service and are separate from the time required to create the artwork.

For international orders, the client is responsible for any customs duties, import taxes or other charges imposed by the destination country, where applicable.

The client is responsible for providing an accurate delivery address. If an order needs to be resent because an incorrect or incomplete address was provided by the client, additional postage costs may apply.

  1. Damage or Loss in Transit

I take care to package every original artwork securely before dispatch.

If your portrait arrives damaged, please contact me as soon as possible and provide photographs of both the artwork and its packaging. Please keep the original packaging until the matter has been resolved, as it may be required as evidence for a delivery claim.

I will work with you to resolve the issue appropriately and in accordance with your statutory consumer rights and the circumstances of the delivery.

If an artwork is lost in transit, I will investigate the matter with the relevant delivery service and discuss the appropriate next steps with you.

As every portrait is an original, an exact replacement may not always be possible. However, I will always aim to create the closest possible reproduction. Any remedy will depend on the circumstances and your applicable legal rights and will be considered on a case-by-case basis.

If a replacement is agreed upon, I will provide a new estimated timeline for the replacement artwork, which must be confirmed by you before I begin the recreation process.

  1. Returns & Refunds

Because commissioned pet portraits are personalised artworks created specifically for an individual client, they are treated differently from standard, non-personalised products in relation to change-of-mind cancellations.

However, this does not affect your statutory rights.

If your portrait is faulty, damaged, not as described, or the service has not been provided with reasonable care and skill, please contact me so that I can discuss the appropriate remedy with you.

Where a refund, replacement, repair, price reduction or other remedy is required by law, I will comply with the applicable consumer legislation.

Nothing in these Terms & Conditions is intended to remove or restrict your statutory consumer rights.

  1. Gifts

If a portrait is being commissioned as a gift, it can be sent directly to the recipient where this has been agreed in advance.

The client is responsible for providing the correct delivery details.

If a portrait is intended as a surprise or gift, please let me know when booking. I will avoid sharing photographs of the finished portrait publicly until the intended recipient has received it.

Premium gift packaging is available upon request at an additional cost.

14. Copyright & Use of Artwork

I retain the copyright and intellectual property rights in all artwork I create.

Purchasing an original portrait does not transfer copyright or reproduction rights to the client.

The client may display and enjoy the original artwork for personal use but may not reproduce, resell, commercially exploit, licence, scan, print, manufacture merchandise from or otherwise distribute copies of the artwork without my prior written permission.

I may photograph or scan completed artwork and use images of my work for my portfolio, website, social media, marketing, exhibitions and other promotional purposes.

If you would prefer your commissioned portrait not to be used publicly, please let me know before the commission is completed and I will respect this request where reasonably practicable.

For portraits commissioned as gifts, I will take reasonable care not to publicly share the finished artwork before the recipient has received it where the client has informed me that the portrait is intended to be a surprise.

15. Privacy & Personal Data

I collect and use personal information such as your name, email address, delivery address and commission details in order to respond to enquiries, process and fulfil commissions, arrange delivery, communicate with you and keep appropriate business records.

Photographs supplied for the purpose of creating a portrait may also be stored and used as necessary to complete and manage the commission.

Personal information will be handled in accordance with my Privacy Policy.

16. Complaints & Contact

I will always aim to resolve concerns fairly and directly.

Please provide as much relevant information as possible so that I can understand the issue and work with you towards an appropriate resolution.

Nothing in this section limits your statutory consumer rights.

17. Changes to These Terms

I may update these Terms & Conditions from time to time to reflect changes to my business, services or applicable requirements.

The version of the Terms & Conditions that applies to your commission will be the version in place when your commission is confirmed.

Any changes made after a commission has been confirmed will not retrospectively alter the terms of that existing commission unless agreed with you or required by law.

18. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Nothing in these Terms & Conditions affects any mandatory consumer rights or protections that apply to you under applicable law.
